§ 1 GENERAL PROVISIONS
- These Terms and Conditions set out the rules for using the Online Shop and Online Printing Service available at www.huuft.com, including the rules for concluding Sales Agreements, placing Orders, delivering Products, and the complaint procedure and rules for withdrawing from the agreement.
- The owner of the Shop and the administrator of personal data is: Arissima Limited Liability Company. with its registered office in Warsaw at ul. Podwale 13/111, 00-252 Warsaw, entered in the Register of Entrepreneurs (registration details: NIP 8371874602, KRS 0000992013, REGON 523112553 ), email address: office@huuft.com.
- The terms used in these Terms and Conditions shall have the following meanings:
- Seller/Printing house – Arissima Limited Liability Company.
- Shop – the website available at www.huuft.com, through which the Customer may place Orders.
- Customer – a natural person, legal person or organisational unit without legal personality, to which the Act grants legal capacity, using the Shop.
- Consumer – a natural person performing a legal transaction with an entrepreneur that is not directly related to their business or professional activity.
- Entrepreneur – a natural person, legal person or organisational unit that is not a legal person, conducting business or professional activity on its own behalf.
- Entrepreneur with consumer rights – a natural person concluding a contract directly related to their business activity, where the content of the contract indicates that it is not of a professional nature for that person.
- Finished Product – a movable item available in the Shop (e.g. a ready-made poster, frames, accessories) that is not a product manufactured according to the Customer's specifications.
- Customisable Product (Made to order) – a non-prefabricated item, manufactured according to the Customer's specifications or serving to satisfy their individual needs (e.g. a printout from their own file, a design created in the Configurator).
- Digital Product – digital content that is not delivered on a physical medium (e.g. a downloadable image file).
- Configurator – an electronic tool available in the Shop, enabling the Customer to create visualisations and graphic designs.
- Order – a declaration of will made by the Customer using the Order Form and aimed directly at concluding a Product Sales Agreement with the Seller.
§ 2 ELECTRONIC SERVICES AND TECHNICAL REQUIREMENTS
- The following Electronic Services are available in the Shop: Customer Account, Order Form, and Configurator.
- The Customer Account can be used after completing the registration form. The Customer Account service is provided free of charge for an indefinite period. The Customer may delete their Account at any time and without giving any reason by sending a relevant request to the Seller.
- The Configurator is an electronic service enabling the Customer to independently design Configurable Products or upload their own graphic files.
- The visualisations presented in the Configurator are for illustrative purposes only. The Seller reserves that differences in colour reproduction on the monitor and in print are a natural feature of printing processes and do not constitute a defect in the Service.
- The following are necessary for the proper use of the Shop:
- a terminal device with Internet access and a web browser;
- an active email account;
- cookies and Javascript enabled.
- It is prohibited for the Customer to provide unlawful content and to use the Shop in a manner that disrupts its functioning, in particular by sending unsolicited commercial information (spam) or using software that may disrupt the Seller's IT systems.
- To the fullest extent permitted by law, the Seller shall not be liable for any disruptions, including interruptions in the functioning of the Shop, caused by force majeure, unlawful actions of third parties or incompatibility of the Online Shop with the Customer's technical infrastructure.
§ 3 PLACING ORDERS AND PREPARING FILES
- Orders are placed via the Store's website using the Order Form and the Configurator. Browsing the product range does not require creating an Account. To place an Order, you must register and have an active Customer Account.
- Ordering Process: In the case of Configurable Products, the Customer is obliged to upload a graphic file or prepare a design in the Configurator.
- File Acceptance: Clicking the „Add to basket” button (or equivalent) constitutes the Customer's final acceptance of the visualisation, technical parameters and content of the design. From this moment on, the Customer cannot interfere with the file.
- Technical Requirements and Responsibility:
- Colour schemes (RGB vs CMYK): Graphic files should be prepared in CMYK colour space. Files sent in RGB or other colour spaces will be automatically converted to CMYK, which may result in changes in colour tone or saturation. These differences are due to printing technology and do not constitute grounds for complaint.
- Declines and Margins: Important graphic and text elements should be placed within a safe margin (min. 3-5 mm from the edge of the net format), and the background of the graphics should extend beyond the net format (bleeds). Failure to comply with these rules may result in text being cropped or white edges appearing, for which the Printing House is not responsible.
- Resolution: The recommended graphic resolution is 300 DPI. Sending files with a lower resolution may result in reduced print quality („pixelation”), which is not subject to complaint.
- Substantive errors: The printing house does not check files for factual, spelling or linguistic errors. The customer is solely responsible for the content.
- Compliance with instructions: Materials provided by the Customer should be prepared in accordance with the instructions and mock-ups provided by the Seller on the Product page (if available). Failure to follow the guidelines may result in negative file verification or printing errors, for which the Seller is not responsible.
- No possibility of changes: Once the order status has been changed to „In progress” (sent to print), it is not possible to cancel the order or replace the files.
- Refusal to perform: The printing house reserves the right to refuse to fulfil an Order if the materials sent contain unlawful content, incite hatred, are pornographic or clearly infringe the copyrights of third parties.
- Archiving: Saved and purchased designs are visible in the Customer panel. However, the printing house does not guarantee indefinite storage of production files and is not responsible for their possible loss as a result of IT system failures.
- Cancellation due to missing files: In the case of Orders for Customisable Products for which the Customer has not uploaded the correct graphic files (or has not accepted the design) within 14 days of placing the Order, the Seller reserves the right to cancel the Order and refund the payment.
§ 4 PRICES AND PAYMENTS
- The prices of Products listed in the Shop are gross prices and include VAT. The Seller reserves the right to change the prices of goods at any time (the change does not apply to Orders paid for before its introduction).
- The Customer may choose the following payment methods: electronic payments (payment cards, instant transfers) supported by Stripe. The Seller shall not be liable for any delays in the fulfilment of the Order resulting from extended payment authorisation times by banking systems or payment operators.
- The shop does not offer cash on delivery. Orders are processed only after payment has been made.
- The Sales Agreement is concluded upon confirmation by the Seller of acceptance of the Order for execution, which follows after successful payment and acceptance of the files for printing.
- By accepting these Terms and Conditions, the Customer agrees to the issuance and sending of invoices and receipts in electronic form (e.g. PDF file) to the e-mail address provided in the Order.
§ 5 ORDER FULFILMENT AND DELIVERY
- The Order completion date consists of the production time (specified for each Product) and the delivery time by the carrier.
- Products are delivered within the territory of the Republic of Poland (InPost Courier, InPost Parcel Lockers) and to selected foreign countries (International Courier).
- The shop does not have a stationary customer service point and does not offer the option of personal collection.
- Delays: The seller allows for the possibility of extending the delivery time:
- by a maximum of 2 working days due to an unexpected increase in production;
- the time necessary to remove the effects of random events beyond the Seller's control (force majeure, machine failures, power or internet outages, raw material shortages).
- Withdrawal by the Printing House:
- The Seller reserves the right to withdraw from the Agreement within 14 days of its conclusion for important technological reasons (e.g. serious failure of machinery) or logistical reasons (e.g. lack of availability of raw materials from suppliers), after prior notification to the Customer and immediate refund of the funds paid.
- In the case of Customers who are not Consumers (Entrepreneurs), the Seller has the right to withdraw from the Sales Agreement within 14 days from the date of its conclusion without giving any reason. Such withdrawal does not give rise to any claims on the part of the Customer.
- It is recommended to check the condition of the parcel in the presence of the courier. If the packaging or contents are damaged, it is recommended to draw up a damage report. This will facilitate the process of claiming compensation from the carrier.
§ 6 RIGHT TO WITHDRAW FROM THE CONTRACT (RETURNS)
- The consumer has the right to withdraw from the contract within 14 days without giving any reason, subject to paragraph 2.
- Exclusion of the right of withdrawal: Pursuant to Article 38(3) of the Consumer Rights Act, the right to withdraw from a contract concluded outside the business premises or at a distance not entitled The Consumer in relation to contracts where the subject of the service is a non-prefabricated item, manufactured according to the Consumer's specifications or serving to satisfy their individual needs. This means that Customisable Products (made to order, with your own photo or design) are non-returnable.
- In the case of Ready-made Products (non-prefabricated), the Consumer may withdraw from the contract by submitting an appropriate statement to the Seller. The cost of returning the goods shall be borne by the Consumer.
- In the case of Digital Products, the right to withdraw from the contract expires when the Consumer agrees to the delivery of digital content before the expiry of the withdrawal period (e.g. by starting to download the file).
- If the Consumer exercises their right to withdraw from the contract after requesting the commencement of service provision before the expiry of the withdrawal period (e.g. design service), they are obliged to pay for the services provided until the moment of withdrawal from the contract.
§ 7 COMPLAINTS (PHYSICAL DEFECTS AND PRINT QUALITY)
- The Seller is obliged to deliver a Product free from defects to the Customer.
- Specifics of printing: Colour differences resulting from individual monitor settings (RGB) in relation to the printout (CMYK) do not constitute grounds for complaint.
- Dimensional tolerance: Due to bookbinding processes, dimensional tolerance and image displacement (bleeds) of up to 2 mm are acceptable. These deviations are not considered a defect in the Product.
- Material tolerance: Due to the specific nature of substrate production (including textile materials), individual batches of material may differ slightly from one another (e.g. in terms of weave, shade, weight). These differences, resulting from the technological processes of raw material suppliers, do not constitute a defect in the Product.
- Complaints should be submitted electronically to the Seller's e-mail address or in writing. The complaint should include a description of the defect and, if possible, photographs documenting the defect.
- The seller shall respond to the consumer's complaint within 14 days.
- Liability towards Businesses (B2B): For Customers who are not Consumers:
- The Seller's liability under the warranty for physical defects is excluded (Article 558 § 1 of the Civil Code).
- The Seller's liability for damages is limited to the value of the Order placed and does not include lost profits.
- The deadline for submitting complaints (obvious defects) expires on the 14th working day from the date of receipt of the shipment.
- If the Seller requests additional documentation for the complaint (e.g. photographs), the Customer is obliged to send it within 7 working days. Failure to meet this deadline will result in the complaint being rejected.
§ 8 COPYRIGHT AND RESPONSIBILITY FOR CONTENT
- The Customer declares that they hold all copyrights to the graphic files and content to be recorded on the Products.
- The Customer shall be solely liable for any infringement of third party copyrights. In the event of any claims being made against the Seller by third parties in connection with the execution of the order (e.g. infringement of copyright or personal rights), the Customer undertakes to release the Seller from all liability and to cover all costs incurred by the Seller in connection with such claims (including legal costs).
§ 9 PROTECTION OF PERSONAL DATA
- The Seller is the administrator of Customers' personal data.
- Personal data is processed for the purpose of fulfilling Orders, maintaining Customer Accounts and, in the case of separate consent, for marketing purposes.
- Detailed rules for the processing of personal data and customers' rights (GDPR) are described in the Privacy Policy available in the Shop.
§ 10 OUT-OF-COURT METHODS OF HANDLING COMPLAINTS
- The consumer has the option of using out-of-court methods of handling complaints and pursuing claims.
- Detailed information on the possibility for Consumers to use extrajudicial means of dealing with complaints and pursuing claims, as well as the rules for accessing these procedures, is available at the offices and on the websites of district (municipal) consumer ombudsmen, social organisations whose statutory tasks include consumer protection, Provincial Trade Inspection Inspectorates and at the website of the Office of Competition and Consumer Protection.
- Consumers may also use the ODR platform available at: http://ec.europa.eu/consumers/odr.
§ 11 FINAL PROVISIONS
- Contracts concluded through the Shop are concluded in Polish.
- The Seller reserves the right to amend the Terms and Conditions for important reasons, i.e. changes in legal regulations, changes in payment and delivery methods – to the extent that these changes affect the implementation of the provisions of these Terms and Conditions. The Seller shall notify the Customer of any changes at least 7 days in advance.
- In matters not covered by these Terms and Conditions, the generally applicable provisions of Polish law shall apply, in particular: the Civil Code; the Act on the provision of electronic services; the Act on consumer rights.
- Any disputes arising from the Terms and Conditions or Sales Agreements shall be settled by a common court of law with jurisdiction over the Seller's registered office, unless mandatory provisions of law provide otherwise (this applies in particular to disputes with Consumers).
